Delhi High Court Turns Blind Eye, Dismisses Plea to Postpone CA Exams Despite Lok Sabha Polls Clash
In a disappointing decision for Chartered Accountant aspirants, the Delhi High Court on April 8th dismissed a plea filed by 27 students seeking to postpone the upcoming CA Inter and Final examinations until June. The students had raised legitimate concerns about the exams clashing with the 2024 Lok Sabha elections, which could lead to transportation disruptions and other issues affecting their ability to take the crucial tests.
Justice C. Harishankar’s curt dismissal of “Is there some law that says there can’t be any exams during Lok Sabha elections?” fails to appreciate the very real logistical challenges thousands of students may face. With polls scheduled for May 7th and 13th, the students rightly pointed out that getting to exam centers could be extremely difficult on those days.
The court’s argument that the “mere fact that the candidates may face hardship” is not enough to postpone an exam for over 4 lakh students rings hollow. Preparing for chartered accountancy exams is an immense undertaking, and any disruption can severely impact years of intense preparation and financial investment for families.
While the Institute of Chartered Accountants of India (ICAI) has rejigged some dates to avoid the actual polling days, that is insufficient given the clarion call by the Election Commission for people to start returning to their home constituencies well before the polls. The resultant transport stress could severely disadvantage out-station students who make up a large percentage of CA aspirants.
The High Court dismissing the plea out of hand without considering possible accommodations is deeply disheartening. With a little flexibility and pragmatism, ICAI could have avoided putting students through undue hardship during a critical national electoral exercise. Prioritizing student welfare over inflexible scheduling would have been a progressive step for both the court and the chartered accountancy body.
