Indian constituion under fire? Rahul Gandhi’s Berlin broadside and India’s democratic debate

During an interaction with the students in Hertie School, in Berlin, Germany, Congress leader Rahul Gandhi stirred political debate by alleging that Bharatiya Janta Party (BJP) is attempting to undermine and ultimately eliminate the spirit of the Indian constitution.

These statements on an international platform did not take long to create a ripple effect back home, adding to the charged-up political environment. Gandhi claimed that the constitution of India- built on principles of equality, secularism, federalism and social justice is under sustained preessure. According to him, institutions meant to safeguard democracy, such as Parliament, the judiciary, and independent bodies are being weakened. He argued that this, in effect, amounts to an assault on the constitutional framework rather than a direct, formal abolition.

“What the BJP is proposing essentially is the elimination of the Constitution. Elimination of the idea of equality between states, elimination of the idea of the central core of the Constitution, which is that every individual will have the same value,” the leader of opposition in Lok Sabha said to a group of students at the Hertie School.

Mr. Gandhi also added, “Politics is the art of listening. We will deal with it, and we will create a method, a system of opposition resistance that will succeed. But, we’re not fighting the BJP. You have to understand that we’re fighting their capture of the Indian institutional structure.” Responding to questions from students, Rahul Gandhi claimed that the institutional framework in India has been weaponised.

“We fundamentally believe that there is a problem with the electoral machinery in India. The second thing is that there is a wholesale capture of our institutional framework. There is a full-scale assault taking place on the institutional framework of our country,” he claimed. Speaking in Berlin, Gandhi positioned his comments as a warning rather than a rhetorical attack. He streesed that the Constitution is not merely a legal document but a social contract that protects India’s diversity and gives voice to marginalized communities. Any attempt to dilute its value, he said, threatens the very idea of India as a pluralistic democracy.

“If you are going to have any conversation about democracy on the planet, you cannot ignore by far the largest and most complex democracy in the world. That is why I say Indian democracy is a global public; it is not just an Indian asset, it is a global asset.” Mr. Gandhi observed, “So when I talk of the attack on the Indian democratic system, I don’t say it, but it is actually an attack on the global democratic system.”

“But, that’s not how the BJP sees (it). It views the institutional framework of India as belonging to them. So they use it as a tool for building political power. Going by the number of cases that the ED and the CBI have against BJP people and against the opposition, one would find that most of them are political cases,” he said.

“We have tactical contests, and we will continue to have them. But you will see that when it comes to the opposition requiring unity, that happens every day in Parliament. We are very united, and we will contest the BJP on laws that we disagree with,” Mr. Gandhi added.

This interaction highlights a deeper ideological clash in Indian politics: differing interpretations of nationalism, governance, and constituitional values. As India moves toward future elections, such debates are likely to sharpen, with the constitution itself becoming a central symbol in the contest between the ruling party and the opposition.
