SC Denies Interim Voting Rights to 34 Lakh Deleted Bengal Voters; Terms Plea ‘Premature’

Major Blow to Electorate as Apex Court Refuses to Halt Polls for Pending SIR Appeals

In a major blow to millions of residents in West Bengal, the Supreme Court on Monday (April 13) refused to grant immediate interim relief to individuals whose names were purged from the electoral rolls during the controversial Special Intensive Revision (SIR) process.  

With the first phase of the West Bengal Assembly Elections set for April 23, 2026, the apex court’s decision effectively confirms that over 3.4 million (34 lakh) people—whose appeals are currently pending—will not be able to cast their ballots in the upcoming phases.  

‘We Cannot Burden the Tribunals’

A division bench comprising Chief Justice of India Surya Kant and Justice Joymalya Bagchi characterized the request for interim voting rights as “out of the question” at this late stage. Senior Advocate Kalyan Banerjee, representing the petitioners, had argued that denying these citizens the right to vote while their appeals were stuck in a judicial backlog would be a “travesty of democracy.”  

CJI Surya Kant, however, maintained a strict procedural stance. “Where is the question of voting then? Those who have been allowed, we should stay that also then,” he observed, pointing out that if the court allowed pending appellants to vote, it would logically have to consider barring those whose inclusion is currently being challenged by others. The bench emphasized that judicial intervention at this stage could disrupt the entire electoral process. 

The SIR Controversy: A 12% Electorate Wipeout?

The Special Intensive Revision (SIR), conducted by the Election Commission of India (ECI), has been one of the most scrutinized electoral exercises in recent history. The data presented during the hearings paints a staggering picture. Nearly 90.8 lakh names were deleted during the initial clean-up process. The ECI categorized many deletions under “logical discrepancies” and issues regarding “legacy linkage” to older electoral records. According to reports from the Calcutta High Court, approximately 34.35 lakh appeals were filed by April 11, following the publication of the final rolls.  

Justice Bagchi noted that while the right to vote is a vital constitutional right, a “margin of error” is expected in an exercise of this magnitude. “If the accuracy is 70 percent then the activity should be rated as excellent,” the judge remarked, though he acknowledged the aspirational rights of the genuine voters currently excluded.  

The “Frozen” Roll and Security Concerns

The court noted that for the 123 constituencies participating in the first phase on April 23, the electoral rolls were frozen as of April 9. No new names can be added to these lists unless a specific judicial order is passed, which the bench declined to issue today.  

Furthermore, the Supreme Court addressed the safety of the judicial officers overseeing the SIR adjudication. Following reports of a “gherao” and harassment of officers in districts like Malda, the court directed that security cover for all officers involved must continue until the completion of the elections.  

What Happens Next?

The Supreme Court has directed all affected individuals to continue pursuing their cases through the 19 designated Appellate Tribunals. However, with each tribunal reportedly handling over one lakh cases, it is physically impossible to resolve the 3.4 million pending appeals before the state goes to the polls on April 23 and April 29. 

As West Bengal prepares for a high-stakes battle between the ruling TMC and the opposition BJP, the exclusion of 3.4 million voters remains a significant point of contention. The focus now shifts to the polling booths, while the legal battle over the SIR process is expected to continue long after the results are declared on May 4, 2026.
