Supreme Court Warns EC Over Bihar Voter List: Will Intervene if Guidelines Are Breached

Supreme Court Warns Election Commission on Voter List Process in Bihar
The Supreme Court cautioned the Election Commission of India (EC) on Monday, saying it will interfere if the EC violates legal norms during the ongoing update of Biharโs draft electoral roll. The Court gave this warning while hearing a plea challenging the use of Aadhaar and Voter ID for verifying citizenship.
Petitioners Oppose Aadhaar-Based Verification
The petitioners told the Court that the Election Commission cannot demand Aadhaar or Voter ID to determine citizenship. They argued that this process could wrongly exclude valid voters, particularly from marginalised communities, and violate their privacy rights. They asked the Court to stop the publication of the draft electoral roll immediately.
Court Refuses Stay, But Issues Stern Warning
Justice Sanjiv Khanna, who led the bench, refused to grant an interim stay on the publication. However, he firmly warned the EC. โWe will not stay the process now, but we will interfere if the Election Commission steps outside legal limits,โ he said.
Election Commission Defends Its Move
The EC defended its use of Aadhaar. It claimed that it collects Aadhaar information only with consent and uses it to clean up fake or duplicate entriesโnot to verify citizenship. The EC assured the Court that it follows the law strictly.
Supreme Court Seeks More Details
The bench directed the EC to file a detailed affidavit within four weeks. It also asked the petitioners to submit any evidence showing illegal exclusions or misuse of the verification process. The Court will review both submissions in the next hearing.
What This Means
The case raises serious concerns about the use of personal ID data in elections. If the Court finds that the EC crossed legal boundaries, it could set a new precedent for how the government handles voter verification. The outcome may influence not only Bihar but also the way elections are conducted across India.
