No relaxation allowed to 2020 delhi riot accused Tahir hussain

Former municipal councillor, Tahir Hussain moved a plea for interim bail at Delhi district court (Karkardooma court). His petition was filed on the grounds of poor medical condition. The court has released a notice to the Delhi police and ordered the jail authorities to give a report of Hussain’s medical state.

His plea brought the attention once again to one of the prominent cases emerging from communal unrest that the national capital in February 2020 experienced . This communal riot led to the deaths of more than 50 peoples, while many were injured and large-scale property damage was reported.

He has been charged with the unlawful activities prevention act (UAPA) and various sections of Indian penal court (IPC) and accompanied by other accused like sharjeel Iman , Umar Khalid and khalid Saifi.

The application states that “he is suffering from an inguinal hernia. It is imperative that surgery be performed as soon as possible; however, the jail hospital lacks the necessary facilities. Therefore, I request an interim bail of one month to facilitate the surgery and the subsequent post-operative care. And also, that once the time is up, he will surrender himself and will not tamper with any evidence.”

In January 2025, Hussain attempted to secure interim bail; however, the two-judge bench of the Supreme Court was divided in its verdict. Nevertheless, Hussain was granted custody parole on a daily basis to campaign in the Delhi elections, and the case was referred to a larger bench.

And this time as well, when Tahir’s plea came up for hearing before ASJ Bajpai, the judge directed the concerned authorities to submit Tahir’s medical report by Friday; furthermore, observing that the allegations against him appeared prima facie true, the court dismissed his bail application. Meanwhile, hearings regarding this case are still ongoing in the court.
