Supreme Court to Step In: West Bengal’s OBC List Under Review Once More

A Key Hearing Scheduled for July 28 Regarding Reservation Policies
The ongoing legal dispute concerning West Bengal’s Other Backward Classes (OBC) list is poised to escalate as the Supreme Court of India prepares to hear the state government’s appeal against a Calcutta High Court’s stay on its recent OBC list initiative on July 28. This forthcoming hearing carries substantial consequences for reservation policies and the equilibrium of authority between the executive and judiciary in India.


The issue originated from the Calcutta High Court’s ruling to stay a new OBC list compiled by the West Bengal government. This stay was enacted after the High Court, in May 2024, had already annulled the inclusion of 77 communities in a prior OBC list. The state subsequently informed the Supreme Court of its intention to conduct a new exercise to identify OBCs. However, the High Court later stayed at this new initiative, noting that the state seemed to be attempting to reintroduce the same classes that had been previously invalidated, and raised concerns about the necessity of legislative action as opposed to executive orders.


The West Bengal government, represented by Senior Advocate Kapil Sibal, requested an urgent hearing, arguing that the High Court’s decision was inconsistent with previous Supreme Court rulings, especially the 1992 Indira Sawhney judgment, which permits the executive to determine OBCs. The state asserts that its new list is founded on a comprehensive socio-economic survey. The results of the July 28 hearing will be closely monitored, as it could establish a vital precedent for how states recognize and apply OBC reservations, potentially affecting numerous individuals who are awaiting clarity regarding their eligibility for benefits and opportunities.
