Public Safety Act Case Dismissed by J&K Court

On July 23, 2025, the Jammu and Kashmir High Court dismissed a habeas corpus petition filed by a Doda resident. The petitioner challenged the detention of a man under the Jammu and Kashmir Public Safety Act (PSA). The court, however, upheld the detention. It ruled that individual liberty must give way when national security comes under threat.

Justice M.A. Chowdhary emphasized that the state must act firmly in such cases. He asserted that the petitioner failed to establish any legal error in the detention process. The court maintained that the grounds of detention were legally valid and well-supported by material facts.

J&K Court on Public Safety Act: Criticism Versus Justification

The Public Safety Act, often criticized for its preventive detention clauses, gives authorities the power to detain individuals without trial for extended periods. In this case, the authorities labeled the detained man an “overground worker” supporting militant activities in the region.

The judge cited previous Supreme Court rulings where national interest prevailed over individual liberty. He concluded that the preventive detention was a justified measure to ensure peace in the region. The court also stated that procedural safeguards had been observed while issuing the detention order.

The petitioners argued that the detention violated constitutional rights under Article 21. However, the High Court held that such rights can be curtailed when public order or national integrity faces danger.

The bench emphasized that laws like PSA become essential in conflict-prone zones like Jammu and Kashmir. According to the judgment, even minimal involvement in militancy networks poses severe threats. Hence, preemptive actions remain necessary to prevent escalation.
