The school jobs scam in West Bengal has entered a new legal chapter as a Public Interest Litigation (PIL) seeks criminal prosecution of officials, seizure of their assets, and rapid replacement of terminated teachers to safeguard studentsโ€™ education.

Supreme Court Verdict on School Jobs Scam

The Supreme Court exposed deep-rooted irregularities in the 2016 recruitment process run by the West Bengal School Service Commission. It declared the appointments unlawful, citing violations of Articles 14 and 16 of the Constitution.

The court annulled every appointment found tainted and mandated the state to complete fresh recruitment by December 31, 2025. It allowed only untainted assistant teachers of Classes 9โ€“12 to continue temporarily, ensuring classroom stability while the hiring process restarts.

PIL Pushes for Criminal Action and Asset Seizure

Activist Devdutta Maji and his civic group prepared a PIL demanding:

  • Criminal charges against every implicated official.
  • Seizure of movable and immovable properties of those accused.
  • Immediate recruitment of qualified teachers to avoid disrupting academic schedules.

Maji described the scam as a betrayal of childrenโ€™s futures and the education systemโ€™s integrity, urging swift, uncompromising action.

Details of the Recruitment Fraud

The 2016 process aimed to fill 25,753 posts, including teaching and non-teaching positions. Investigations by the CBI and ED uncovered massive fraud:

  • Manipulated OMR sheets.
  • Fake merit lists.
  • Appointment letters issued to candidates with zero marks.
  • Middlemen facilitating bribe-driven selections.

Evidence linked some high-ranking officials, including West Bengal Minister Chandranath Sinha, to suspicious transactions worth over โ‚น1.5 crore.

Social Fallout and Protests

The annulment displaced thousands of teachers, triggering street protests:

  • May 15, 2025 โ€” Demonstrations at Bikash Bhawan, Kolkata ended in clashes, injuring around 30 teachers.
  • May 30, 2025 โ€” Over 100 protesting teachers were detained across Kolkata.

Many dismissed staff applied for reinstatement in other government roles. So far, about 20 have been reappointed, with over 4,500 applications pending review.

High Court and Enforcement Directorate Actions

In April 2024, the Calcutta High Court annulled the recruitment and ordered probes. The Supreme Court upheld this decision in April 2025.

The High Court later rejected pleas to include tainted candidates in fresh hiring, warning that it would erode trust in the education system.

Meanwhile, the Enforcement Directorate filed a chargesheet against Minister Chandranath Sinha and 54 others. It accused them of taking bribes from job aspirants and laundering the funds.

Urgency for Fresh Recruitment in School Jobs Scam

The Supreme Court has ordered the state to begin new recruitment by May 31, 2025, and finish by year-end. This timeline aims to fill vacancies quickly without compromising merit-based selection.

The PILโ€™s demand for criminal action, combined with the courtโ€™s strict deadlines, could lead to one of the most significant overhauls in West Bengalโ€™s education hiring system.

Balancing Accountability and Educational Continuity

The school jobs scam case underlines the challenge of holding wrongdoers accountable without disrupting learning. While the Supreme Court seeks to restore meritocracy, activists push for stronger deterrents against future fraud.
