The National Herald Case: Everything You Need to Know
National Herald case has emerged as one of the most closely-watched legal battles in recent Indian political history. It touches not just on financial and corporate issues but also raises questions about ethics, political power, and legal accountability. Hereโs a comprehensive look at the case, simplified and broken down for everyone to understand.
What Is the National Herald?
The National Herald was a newspaper established in 1938 by Pandit Jawaharlal Nehru, India’s first Prime Minister. It was intended to support the freedom movement and became a voice for the Indian National Congress. Over the decades, however, the paper struggled financially and eventually shut down operations in 2008 due to mounting losses.
Where Did the Controversy Begin?
The controversy started when it was revealed that a company named Young Indian Pvt. Ltd., in which Sonia Gandhi and Rahul Gandhi held majority shares, had acquired the Associated Journals Ltd. (AJL) โ the original publisher of the National Herald newspaper.
This deal became the center of a legal storm when BJP leader Subramanian Swamy filed a private complaint in 2012, alleging financial fraud and misuse of political power.
The Allegations in the Case
Dr. Swamy‘s complaint made serious claims, including:
Misappropriation of assets: AJL had real estate assets worth over Rs 2,000 crore. It was alleged that these were illegally taken over by Young Indian for a paltry sum.
No proper payment: The Congress Party had given AJL a loan of Rs 90 crore, which was never repaid. Instead, Young Indian took over AJL by acquiring that loan for just Rs 50 lakh.
Conflict of interest: Since key Congress leaders were shareholders in Young Indian, Swamy alleged that this was a case of money laundering and cheating.
Who Are the Main People Involved?
Sonia Gandhi : Congress President and one of the main shareholders in Young Indian.
Rahul Gandhi : Then Congress Vice President, and another main shareholder.
Motilal Vora and Oscar Fernandes: Senior Congress leaders who were on the board of both AJL and Young Indian.
Subramanian Swamy: BJP leader and petitioner in the case.
Legal Developments and ED Investigation
In 2014, a Delhi court took cognizance of Swamyโs complaint and summoned Sonia and Rahul Gandhi. Over the years, the case gathered momentum:
The Enforcement Directorate (ED) began investigating the case under the Prevention of Money Laundering Act (PMLA).
In 2022, both Sonia and Rahul were questioned by the ED in marathon sessions.
The ED also sealed and temporarily took control of AJLโs premises in Delhi as part of the investigation.
The Congress Party strongly protested the move, calling it โvendetta politics.โ
