Centre seeks SC hearing before orders are passed on pleas challenging Waqf Act

The Centre has filed a caveat in the Supreme Court, seeking a hearing before any order was passed on the petitions challenging the constitutional validity of the Waqf (Amendment) Act, 2025. A party files a caveat in the high courts and the Supreme Court to ensure that no orders are passed without hearing it.
Lawyers privy to the development said the petitions were likely to be listed for hearing before a bench on April 15. The Supreme Court website has not reflected this as of now. On Saturday, April 5, President Droupadi Murmu gave her assent to the bill. The Parliament passed it after heated debates in both houses.
Who are the petitioners?
The petitioners include Congress MP Mohammad Jawed, AIMIM President Asaduddin Owaisi, and AAP MLA Amanatullah Khan, along with All-India Muslim Personal Law Board, and Jamiat Ulama-i-Hind, who have filed a total of 10 petitions with the Supreme Court to challenge the validity of the recently enacted Waqf Act.
The Rashtriya Janata Dal (RJD) also announced its plan to challenge the Waqf Amendment Bill in the Supreme Court, with Rajya Sabha MP Manoj Jha and party leader Fayaz Ahmed filing a petition on the party’s behalf.
On April 7, a bench headed by Chief Justice Sanjiv Khanna assured senior advocate Kapil Sibal, appearing for Jamiat Ulama-i-Hind, to consider listing the petitions.
Union Law Minister Arjun Ram Meghwal told ANI that the Waqf Act doesn’t violates the constitution. In response to petitions filed with the Supreme Court, Meghwal acknowledged the right to seek judicial review, but emphasized that the authority to amend legislation rests exclusively with Parliament.
