Police Delay, School Failures in Badlapur Child Abuse Case Fuel Nationwide Anger

The Badalpur police confirmed that the incident of two kindergarten girls being sexually abused in a school toilet was reported on August 13. The shocking incident came to the fore on August 16 when one of the victims burst into tears and described her ordeal to her parents. The accused was arrested the next day under stringent provisions of the POCSO Act and various sections of the Bharatiya Nyaya Sanhita, which include charges of rape, assault, and sexual harassment.

Things came to a head when the girl, hesitant to go back to school, told her parents about the abuse. Upon hearing this, her parents then took the child to the hospital where tests showed the child had indeed sustained injuries related to sexual abuse. “‘Dada’ removed my clothes and touched private parts,” the child reportedly told her parents in a statement that had added to the gravity of the accusations.

However, the parents have accused the local police of delaying the registration of the First Information Report by 12 hours after they lodged a complaint, which has led to extensive outrage. Preliminary investigations showed that the CCTV cameras at the school were not working at the time of the incident. The police have also indicated that the school authorities failed to ensure that the task of taking care of young students was assigned to the female staff.

School management, facing growing unrest, suspended the principal, a class teacher, and a female attendant. But this did little to prevent the rising anger among the parents and the local community. Furious parents and residents staged a ‘Rail Roko’ write-up for a major daily on August 18 at Badlapur railway station, halting trains services from 8 am. The demonstration that was meant to press for immediate severe action against the accused and the school soon turned violent. Some protesters vandalized the school premises and pelted stones at the railway station, which compelled the police to resort to a lathi charge to disperse the crowd. During the fracas, three senior police officers, among them a seasoned inspector, were suspended for negligence in handling the case, while the in-charge of the local police station was transferred.

The case has now come to national scorch; following which, the National Commission for Protection of Child Rights (NCPCR) is going to dispatch a team in Thane to investigate the incident and the delay in the filing of the FIR. “The attitude of the school was insensitive and they tried to suppress the case,” said NCPCR chairperson Priyank Kanungo while expressing concern over the way the school handled the case and the inaction of police, adding that people responsible for the will be brought to book.

The state government responded by forming an SIT to probe the case with Inspector General of Police Aarti Singh as the head. Meanwhile, Deputy Chief Minister Devendra Fadnavis assured the general public that the probe would be proper and fair.

He condemned the incident, sought stricter punishment, and charged caution that the case might become another long battle lined with judicial processes. He said, “I came to know that Badlapur school belongs to some BJP party worker. But, I do not want to bring politics into it.”

The incident has evoked an outrage throughout the country and has raised serious questions, especially regarding children’s safety in educational institutions, amidst strident calls for systemic reforms so that such tragedies never occur again.
