Calcutta HC Frees Bangladeshi After 21 Years: What the Ruling Means for Juvenile Justice and Repatriation (2026)

A 21 Year Prison Sentence That Never Should Have occurred. In March 2026, the Calcutta high court directed the release of a Bangladeshi man who was serving a 21 year term in an Indian prison. The judge ruled that he was in the age of 15 or 16 years at the time of the crime which occurred in 2005. That was, according to the Indian law, a child. The case was based on Juvenile Justice (Care and Protection of Children) Act.

According to this law, a child in conflict with the law cannot be detained for longer than seven years. It was not the first time that the man was imprisoned; he had served three times that number. Upon examining medical age tests, the court declared that he should not be detained any longer as it was against the law and he should be released and sent back home to Bangladesh.

The case had its starting point in Basirhat, a border town in West Bengal. In 2005 a murder happened and three individuals were apprehended. One of them was the young Bangladeshi boy. Police did not treat him as a child. A proper age check was not carried out. He was incarcerated in adult prisons in the last 20 years. An ossification test conducted years later, a medical age assessment, demonstrated that he was a minor when the crime occurred. That was a revelation that altered all things.

There is a bigger problem demonstrated in the case. There are lots of migrants with no birth records or identity documents around the India-Bangladesh border. In the absence of evidence of age, errors are committed. Old cases are currently being reconsidered by the courts to correct these mistakes. The goal is simple. No child ought to lose his/her whole youth due to the failure by the system to put a check against age
