Waqf Bill Sparks Heated Debate in Parliament

New Delhi, April 2, 2025: The Waqf (Amendment) Bill, 2024, has ignited intense discussions in Parliament, pitting the ruling Bharatiya Janata Party (BJP) against a united opposition. The proposed legislation aims to reform the management of Waqf properties but has drawn sharp criticism from opposition parties and Muslim organizations. While the BJP and its allies defend the bill as a step toward transparency, opponents call it unconstitutional and divisive.

What is the Waqf Bill?

The Waqf Bill seeks to amend the Waqf Act of 1995, which governs the administration of Waqf properties in India. These properties are religious or charitable endowments under Islamic law, often used to fund mosques, graveyards, and welfare activities. The government claims that the amendments will modernize Waqf management by introducing digitization and enhancing accountability. Key reforms include:

• Creation of a centralized digital portal for property registration.
• Inclusion of non-Muslim members in Waqf boards.
• Empowering government officials to resolve property disputes.
• Removal of the “Waqf by user” clause for undocumented properties.

Supporters argue these changes will streamline operations and curb mismanagement. However, critics fear they undermine minority rights and dilute the autonomy of Waqf boards.

Support for the Waqf Bill

The BJP is confident of passing the Waqf Bill with support from its National Democratic Alliance (NDA) allies. Parties like the Janata Dal (United), Lok Janshakti Party (Ram Vilas), and Telugu Desam Party have pledged their backing. Leaders from these parties believe the bill addresses long-standing issues without infringing on minority rights.

Union Minister Kiren Rijiju emphasized that the bill’s objective is transparency, not discrimination. “The reforms will benefit all communities by ensuring better governance,” he stated. Shiv Sena and other NDA members have also issued whips to ensure their MPs are present during voting.

In the Lok Sabha, where a simple majority of 272 votes is needed, BJP’s 240 MPs combined with allies’ support are expected to secure passage. Similarly, in the Rajya Sabha, where 119 votes are required, NDA’s strength of 125 MPs makes success likely.

Opposition Pushback

The opposition INDIA bloc has united against the Waqf Bill, labeling it an attack on constitutional values. Congress leader Mallikarjun Kharge called it “unconstitutional” and vowed to defeat what he described as a divisive agenda. Other opposition leaders like Rahul Gandhi and Supriya Sule echoed similar sentiments during strategy meetings held earlier this week.

A major concern is the inclusion of non-Muslim members in Waqf boards. Critics argue this interferes with religious autonomy. Additionally, empowering district collectors to decide property disputes has raised fears of bias toward government interests.

Muslim organizations such as the All India Muslim Personal Law Board (AIMPLB) have also voiced strong opposition. They argue that removing provisions like “Waqf by user” could jeopardize many longstanding properties used for religious purposes but lacking formal documentation.

What Lies Ahead?

The debate over the Waqf Bill reflects deeper political and social tensions in India. While proponents see it as a necessary reform for better governance, opponents view it as an encroachment on minority rights. The bill’s passage seems likely given NDA’s numerical advantage in Parliament. However, its implementation may face legal challenges and protests from affected groups.

As Parliament prepares for a final vote, all eyes remain on how this contentious legislation will shape India’s political landscape and its commitment to pluralism.
