Berlin Court Grants Custody of Indian Baby to German State, Parents Seek Repatriation to India

Berlin Court Grants Custody of Indian Baby to German State

In a recent ruling, a Berlin court has granted custody of a 20-month-old Indian baby to the German state, rejecting the parents’ claim that their child’s injury was accidental. The court deemed this decision to be in the “best interests of the child.”

The child, who has been in foster care in Germany since September 2021, when she was only seven months old, had become the center of a legal battle between the German authorities and her parents, Dhara and Bhavesh Shah. The German authorities accused the parents of mistreating their child, leading to her placement in state-sponsored foster care.

However, the parents have expressed their trust in the Indian government and their hope for the repatriation of their baby back to India. In a statement, they conveyed their belief that India’s Prime Minister Narendra Modi and Minister of External Affairs Dr S Jaishankar would work towards the child’s return. They entrusted their child, named [baby’s name], to the 1.4 billion citizens of Bharat (India).

The court’s decision marks a turning point in this custody battle, raising questions about the circumstances surrounding the child’s injuries and the appropriate course of action. As the case unfolds, attention will likely focus on the actions taken by both the German and Indian governments to address this complex situation and determine the child’s future.

It remains to be seen how the legal and diplomatic efforts between the two nations will progress and what implications this case might have for similar situations involving international custody disputes.
