Heartbreaking Battle for Baby Ariha: Indians Rally to Bring Her Home from German Custody

Online Petition Gains Momentum as Indians Demand Return of Baby Ariha from German Custody

Over 55,000 people have signed an online petition urging German authorities to return 24-month-old baby Ariha to her parents in India. The emotional campaign has gained widespread support, with Indians creating videos to highlight the urgency of the situation.

The plight of baby Ariha caught the attention of Maharashtra Chief Minister Eknath Shinde, who recently wrote a letter to India’s Foreign Minister, S. Jaishankar, seeking assistance in bringing the child back home.

What led Ariha into German custody?

The series of events leading to Ariha’s placement in German custody began in September 2021 when the paternal grandmother accidentally injured the baby. Although the parents promptly took Ariha to the hospital, they were falsely accused of sexual assault, resulting in the child being removed from their care.

In February 2022, the criminal investigation into the parents was closed without any charges filed. Despite this, baby Ariha has yet to be reunited with her family. Berlin Child Services has initiated a civil custody case with the aim of terminating the parents’ rights. Unfortunately, the trial date for this case remains uncertain, and it is anticipated to take 2-3 years.

The parents, currently fighting the case in Germany, express concerns that Child Services may be intentionally prolonging the proceedings in order to utilize the “continuity principle” of child law. This principle stipulates that if a child has resided with the state-appointed caretaker for a significant period, it should remain there, even if the parents are deemed fit for custody.

Another distressing aspect of the situation is the insensitivity displayed by German child services towards Ariha’s cultural and religious identity. Despite her Jain background, the authorities insist on a meat diet, with plans to have her adopted by a German family. Such actions violate the United Nations Convention on the Rights of the Child, to which both India and Germany are signatories.

Consequently, the parents are appealing for Ariha’s repatriation to India, where she can be placed with her maternal or a Jain family under the care and responsibility of Indian child welfare authorities. This approach has been successfully implemented in cases involving Indian children in foster care in other countries such as Norway and the USA, allowing the child to maintain her heritage and build bonds with her extended family.

The emotional plea from Ariha’s parents, the overwhelming support of thousands through the online petition, and the intervention of the Maharashtra Chief Minister highlight the urgent need for a resolution in this distressing custody battle. As the fight continues in a foreign land, the hope is that Ariha’s well-being, cultural identity, and family ties will be prioritized, ultimately leading to her safe return to India.
